“Considerable research has been undertaken to reduce the risk of harm to other groups of inmates that have been identified as “at risk”, particularly Indigenous inmates. Similar principles could be applied to transgender inmates. However, it should be noted that the recent death in custody of a transgender inmate occurred while she was in “strict protection”. This suggests that merely placing transgender inmates “in protection” may not be sufficient.”
